1. 驻地期间的使用权

在双方约定的驻地期间,艺术家可在合理遵守本协议及场地管理规定的前提下,使用所分配的住宿、工作室及公共空间。

2. 艺术家的责任

2.1 驻地活动:艺术家在驻地期间开展任何公开活动、制作活动或其他可能影响场地使用的活动前,应事先获得 ACENTRICSPACE 的确认。艺术家负责其活动的具体安排、相关费用及活动结果,包括但不限于研究、作品制作、展览及相关活动。艺术家原则上自行提供材料、工具和设备;如项目需要,ACENTRICSPACE 可在艺术家提前提出请求后,在能力和实际条件允许的范围内协助寻找材料或设备。

2.2 损坏:艺术家应妥善使用场地、家具、设备及其他设施。因艺术家使用不当造成的损坏,艺术家应承担相应的维修或更换费用。退住前,艺术家应将使用过的空间及设施恢复至原有状态。

2.3 保险:ACENTRICSPACE 不为艺术家提供个人、健康、旅行、作品或财产保险。艺术家应根据自身情况在抵达前购买适当的保险。驻地期间在中国发生的医疗、保险及其他个人相关费用由艺术家自行承担。

2.4 签证:如有需要,艺术家应自行确认并申请适用的签证或入境许可,并确保所需文件完整有效。ACENTRICSPACE 可根据艺术家的国籍和实际需要,在合理范围内提供邀请函及其他必要文件。

2.5 健康与安全:艺术家应遵守适用的健康、安全及场地管理规定,并以安全、负责任的方式使用场地及设备。因艺术家自身不当或不安全的使用行为造成的伤害、损失或损害,由艺术家自行承担责任;因 ACENTRICSPACE 的过失或不当行为造成的情况除外。

2.6 公共空间:除艺术家被分配的卧室外,ACENTRICSPACE 驻地住宿及工作室中的其他区域均属于公共空间,可能由其他驻地艺术家、项目参与者及 ACENTRICSPACE 工作人员共同使用。艺术家应尊重他人的生活及工作空间,避免过度噪音、吸烟等影响他人的行为。

2.7 垃圾处理与清洁:艺术家负责保持所使用空间的基本整洁,并及时处理垃圾。公共区域可能由 ACENTRICSPACE 定期检查;如发现问题,工作人员可要求艺术家进行整改。离开前,艺术家应彻底清洁所使用的空间,不得遗留垃圾。工作室/展览空间应恢复至原状,包括修复墙面上的孔洞或明显痕迹。大型物品或无法通过常规垃圾系统处理的材料,应提前通知 ACENTRICSPACE,并承担由此产生的特殊清运费用。退住后如发现额外清洁、维修或处理费用,ACENTRICSPACE 有权向艺术家另行收取。

2.8 外出与离开驻地:艺术家可自行进行短途旅行或在其他地点过夜。如连续离开驻地并在外住宿,出于紧急联络需要,应提前向 ACENTRICSPACE 提供临时住宿地点及联系方式。

3. 禁止行为

艺术家不得利用 ACENTRICSPACE 的设施从事违反适用法律法规、危及人身或财产安全、严重干扰他人正常生活和工作的活动。对于严重违反本协议、场地安全规定或适用法律法规的行为,ACENTRICSPACE 有权终止驻地安排,且已支付费用原则上不予退还。

3.1 严重干扰邻近居民、其他艺术家或工作人员正常生活和工作的行为,包括危险行为、持续或过度噪音、严重异味、卫生安全隐患或对建筑及设施造成损害。

3.2 制作、存放或使用危险物品,包括但不限于枪械、非法武器、爆炸物及未经批准的易燃危险材料。

3.3 向排水系统倾倒可能腐蚀或堵塞管道的物质或液体。

3.4 未经 ACENTRICSPACE 事先同意,在场地内饲养、收养或长期留置动物。

3.5 违反适用法律法规,或造成严重安全、治安或公共秩序风险的行为。

3.6 未经批准在公共区域组织可能严重影响他人的宗教仪式、政治活动或其他大型集体活动。

3.7 堵塞楼梯、走廊等公共区域,或未经许可在公共区域张贴标识、广告及其他物品。

3.8 未经许可对场地、建筑结构、家具或设备进行改造、拆卸、钻孔或其他永久性修改。

4. ACENTRICSPACE 对艺术家的支持

ACENTRICSPACE 将根据驻地项目及实际条件提供住宿、工作室及相关支持。部分支持需提前与驻地负责人确认,并受场地、人员、设备及时间安排限制。

4.1 活动:艺术家在驻地期间可申请举办至多 1 场公开活动,形式可包括艺术家讲座、工作坊、表演等。活动计划原则上应至少提前 2 周提交,包括活动内容、日期、时间及其他必要信息。涉及翻译或口译的材料应至少提前 1 周提交。ACENTRICSPACE 可根据实际情况提供基础翻译/口译、官网及社交媒体发布、海报设计、照片及视频记录,以及投影仪、音响、麦克风等基础视听设备。设备供应受实际库存及档期限制,特殊设备可能产生额外租赁费用。艺术家负责其他宣传、材料、设备、特殊灯光、作品介绍以及现场安装和撤场。

4.2 展览:艺术家可根据驻地项目的策展安排申请参加驻地相关群展或个展。展览通常持续 3 天至 1 个月。展览参与须根据策展安排、空间条件及 ACENTRICSPACE 的最终确认,不构成艺术家支付驻地费用后的自动展览权利。涉及翻译或口译的材料应至少提前 1 周提交。ACENTRICSPACE 可提供活动发布、海报设计、照片及视频记录,以及根据实际条件提供基础视听设备。艺术家负责其他宣传、材料、设备、特殊灯光、作品介绍以及作品安装和撤场。

5. 作品与创作

艺术家对驻地期间作品的创作、内容、材料及制作过程负责。艺术家应确保其创作方式及材料的使用符合适用法律法规及场地安全要求。除双方另有书面约定外,艺术家保留其作品的所有权及知识产权。

6. 运输

6.1 作品及材料的运输、包装、快递、保险及相关费用由艺术家承担。

6.2 艺术家应至少提前 1 周与 ACENTRICSPACE 协调作品及材料的运输安排。

6.3 艺术家负责确保作品得到适当包装并符合运输要求。

6.4 驻地结束后,如艺术家遗留作品、材料或个人物品且未与 ACENTRICSPACE 提前约定,ACENTRICSPACE 可根据实际情况收取仓储、搬运或处理费用。

7. 安装与撤场

7.1 安装及撤场相关费用,包括人工、制作材料、运输及其他费用,由艺术家承担,除非双方另有约定。

7.2 艺术家应提前与 ACENTRICSPACE 协调安装及撤场方案,不得未经许可对场地或设施进行永久性修改。

8. 信息及影像授权

艺术家同意向 ACENTRICSPACE 提供用于驻地申请、艺术家介绍、展览及项目宣传所需的以下材料:CV/简历、艺术家肖像、Artist Statement、项目计划/项目说明及过往作品图片。

艺术家应在驻地开始后 1 周内补齐 ACENTRICSPACE 所需的上述材料,除非双方另有约定。

艺术家仍保留上述材料及作品的版权。艺术家授予 ACENTRICSPACE 非独占、全球范围、免版税的使用许可,用于 ACENTRICSPACE 自身的官网、社交媒体、新闻及媒体宣传、出版物、展览资料、教育项目、档案及机构推广。ACENTRICSPACE 不得将该许可理解为对艺术家作品版权的转让。

9. 作品销售

9.1 驻地期间的作品销售由艺术家与收藏者直接协商完成,作品销售所得归艺术家所有,ACENTRICSPACE 不收取销售佣金。

9.2 驻地相关展览期间的作品销售由艺术家与收藏者直接协商完成,ACENTRICSPACE 不收取销售佣金。

9.3 与作品销售有关的税费、运输、包装、支付手续费及其他相关费用,由艺术家或买方根据具体交易承担。

10. 作品复制及记录

艺术家同意 ACENTRICSPACE 对驻地期间创作或展示的作品进行摄影、录像及其他形式的记录,并在不改变作品原意的前提下,用于宣传、新闻报道、教育项目、档案、出版物、展览资料及 ACENTRICSPACE 的机构推广。该授权为非独占、全球范围及免版税的使用许可,不构成艺术家作品版权的转让。

11. 驻地费用、预约及取消政策

11.1 驻地费用:

  • 一个月驻地:6600 元人民币;预约费 3300 元;余款 3300 元。
  • 两个月驻地:13000 元人民币;预约费 6500 元;余款 6500 元。
  • 三个月驻地:19000 元人民币;预约费 9500 元;余款 9500 元。

预约费包含在驻地总费用之内,余款需在艺术家抵达前或抵达时支付。

11.2 预约及名额确认:只有在艺术家支付相应预约费后,驻地日期才正式确认。预约费一经支付,不予退还。ACENTRICSPACE 将为艺术家专门保留约定的驻地日期,不再将该时间段提供给其他申请者。

11.3 艺术家取消:

  • 距离预计入住日期 60 天及以上取消:预约费不予退还,但艺术家可申请将本次预约转至其他可用驻地时间。每笔预约仅允许转期一次,新的驻地时间须在原定驻地日期起 12 个月内完成,并以 ACENTRICSPACE 当时的档期为准。
  • 距离预计入住日期不足 60 天取消:预约费不予退还,且不可转期。
  • 未按计划入住:视为取消本次驻地,预约费不予退还。

11.4 日期调整:任何驻地日期调整申请原则上应至少在预计入住日期 60 天前提出。日期调整须经 ACENTRICSPACE 确认,并仅允许一次;完成一次转期/调整后,不得再次转期或调整。

12. 提前结束与延长驻地

12.1 如艺术家自行决定在约定结束日期前提前结束驻地,已支付的费用不予退还,未使用的驻地时间不予折算、退款或转移。

12.2 如艺术家希望延长驻地,应提前向 ACENTRICSPACE 提出申请。延长驻地须根据当时档期及双方确认执行,延长期费用另行计算。

13. 访客及过夜

艺术家可在合理范围内邀请访客进入驻地,但访客不得影响其他艺术家、工作人员或邻近居民的正常生活和工作。访客过夜须事先获得 ACENTRICSPACE 的同意。艺术家对其访客在场地内的行为承担相应责任。

14. 个人物品

艺术家应自行保管个人物品、贵重物品、护照、现金、电脑、作品、材料及设备。除因 ACENTRICSPACE 的故意或过失造成的损失外,ACENTRICSPACE 不对艺术家个人财产的遗失、盗窃或损坏承担责任。

15. 协议终止

如艺术家严重违反本协议、场地安全规定或适用法律法规,或其行为对其他人员、场地或 ACENTRICSPACE 的正常运营造成严重影响,ACENTRICSPACE 有权立即终止驻地。此类情况下,已支付的驻地费用原则上不予退还;艺术家应根据实际情况承担因其行为产生的维修、清理或其他合理费用。

16. ACENTRICSPACE 取消驻地

如因 ACENTRICSPACE 自身原因需要取消已经确认的驻地,艺术家已支付的全部驻地费用将予以退还;如条件允许,双方也可协商调整至其他可用驻地时间。

17. 不可抗力

如因自然灾害、战争、政府政策或限制、重大公共卫生事件、交通中断、签证或入境政策变化及其他双方合理控制范围之外的情况,导致驻地无法正常进行,双方应本着善意原则协商调整驻地日期或其他合理安排。

18. 适用法律及争议解决

本协议适用中华人民共和国法律。因本协议产生或与本协议有关的任何争议,双方应首先通过友好协商解决;如协商无法解决,争议应提交中国上海有管辖权的人民法院处理。

19. 协议确认

艺术家在提交驻地申请并勾选“我已阅读并同意《ACENTRICSPACE 艺术家驻地协议》”后,即确认已阅读、理解并接受本协议的内容。支付预约费后,艺术家进一步确认所约定的驻地日期,并承诺遵守本协议。

如本协议提供中英文两个版本,建议双方确认以签署或接受时所明确的版本为准;如需避免语言歧义,可在最终发布版本中明确约定一个具有优先效力的语言版本。

1. Time of Availability

During the agreed residency period, the Artist may use the assigned accommodation, studio, and communal spaces, subject to this Agreement and the reasonable rules of the premises.

2. Responsibilities of the Artist

2.1 Residency Activities: The Artist must obtain prior approval from ACENTRICSPACE for public events, production activities, or other activities during the residency that may affect the use of the premises. The Artist is responsible for the arrangements, associated costs, and outcomes of their activities, including but not limited to research, production of work, exhibitions, and related events. The Artist is generally responsible for providing their own materials, tools, and equipment. ACENTRICSPACE may assist with sourcing materials or equipment when reasonably necessary for the residency project and requested by the Artist in advance, subject to availability and actual circumstances.

2.2 Damages: The Artist shall use the premises, furniture, equipment, and other facilities with due care. The Artist is responsible for reasonable repair or replacement costs resulting from damage caused by the Artist's improper use. Before checkout, the Artist must restore the spaces and facilities they have used to their original condition.

2.3 Insurance: ACENTRICSPACE does not provide personal, health, travel, artwork, or property insurance for the Artist. The Artist is responsible for obtaining appropriate insurance before arrival according to their own needs. Medical, insurance, and other personal expenses incurred in China during the residency are the responsibility of the Artist.

2.4 Visa: Where required, the Artist is responsible for determining and obtaining the appropriate visa or entry permit and ensuring that all required documents are complete and valid. ACENTRICSPACE may, depending on the Artist's nationality and circumstances, provide an invitation letter and other necessary supporting documents upon request.

2.5 Health and Safety: The Artist must comply with applicable health, safety, and premises regulations and use the facilities and equipment safely and responsibly. The Artist is responsible for injury, loss, or damage arising from their improper or unsafe use of the facilities or equipment, except where caused by the negligence or misconduct of ACENTRICSPACE.

2.6 Communal Spaces: Except for the bedroom assigned to the Artist, the other areas of the ACENTRICSPACE Residency Accommodation and Studio are communal spaces and may be accessed by other resident artists, program participants, and ACENTRICSPACE staff. The Artist must respect the living and working spaces of others and avoid conduct that may unreasonably affect them, including excessive noise and smoking.

2.7 Waste Disposal and Cleaning: The Artist is responsible for maintaining reasonable cleanliness in the spaces they use and for disposing of waste regularly. Communal areas may be inspected periodically by ACENTRICSPACE staff, who may request corrective action where necessary. Before departure, the Artist must thoroughly clean the spaces used and leave no garbage behind. The studio/gallery must be restored to its original condition, including repairing holes or significant marks on walls. Large items or materials that cannot be disposed of through the normal waste system must be reported to ACENTRICSPACE in advance, and the Artist is responsible for any special collection or disposal costs. Any additional cleaning, repair, or disposal costs identified after checkout may be charged separately to the Artist.

2.8 Day Leave and Overnight Stay Elsewhere: The Artist may take day trips or stay overnight elsewhere. If the Artist will be staying away from the residency accommodation, they should provide ACENTRICSPACE with the temporary accommodation address and contact information for emergency purposes.

3. Prohibited Activities

The Artist may not use ACENTRICSPACE facilities for activities that violate applicable laws or regulations, endanger persons or property, or seriously disrupt the normal living or working environment of others. In the event of a serious violation of this Agreement, safety requirements, or applicable laws, ACENTRICSPACE reserves the right to terminate the residency. Payments already made will generally not be refunded, and the Artist may be responsible for reasonable repair, cleaning, or other costs resulting from the violation.

3.1 Actions that seriously disrupt neighboring residents, other Artists, or staff, including dangerous behavior, persistent or excessive noise, serious offensive odors, sanitation hazards, or damage to the building or facilities.

3.2 The production, storage, or use of dangerous goods, including firearms, illegal weapons, explosives, or unapproved flammable or hazardous materials.

3.3 Pouring substances or liquids into drainage systems that may corrode, block, or otherwise damage the pipes.

3.4 Keeping, raising, adopting, or permanently housing animals at the premises without prior approval from ACENTRICSPACE.

3.5 Activities that violate applicable laws or regulations, or create serious safety, security, or public-order risks.

3.6 Organizing religious ceremonies, political activities, or other large collective activities in communal areas without prior approval where such activities may materially affect other residents or the operation of the premises.

3.7 Obstructing communal areas such as stairs and hallways, or posting signs, advertisements, or other materials in communal areas without permission.

3.8 Modifying, dismantling, drilling into, or making permanent alterations to the premises, furniture, or equipment without permission.

4. Support Towards the Artist

ACENTRICSPACE will provide accommodation, studio facilities, and related support according to the residency program and actual circumstances. Certain forms of support require advance consultation with the Residency Director and are subject to the availability of space, staff, equipment, and scheduling.

4.1 Event: The Artist may request to hold up to one public event during the residency, such as an artist talk, workshop, or performance. The event may last up to three hours, excluding installation and removal. A detailed event plan should be submitted at least two weeks in advance, including the content, proposed date and time, and other information required for planning. Materials requiring translation or interpretation should be submitted at least one week in advance. ACENTRICSPACE may provide basic interpretation/translation, event listings on its website and social media, poster design, photographic and video documentation, and basic audiovisual equipment such as a projector, speaker, or microphone, subject to availability. Special equipment may incur additional rental costs. The Artist is responsible for other publicity, materials, equipment, special lighting, presentation of the work, installation, and removal.

4.2 Exhibition: The Artist may apply to participate in a group or solo exhibition related to the residency. Exhibitions normally last between three days and one month. Participation in an exhibition is subject to the curatorial program, available space, and final confirmation by ACENTRICSPACE, and does not constitute an automatic exhibition right arising from payment of the residency fee. Materials requiring translation or interpretation should be submitted at least one week in advance. ACENTRICSPACE may provide event listings, poster design, photographic and video documentation, and basic audiovisual equipment subject to availability. The Artist is responsible for other publicity, materials, equipment, special lighting, presentation of the work, installation, and removal.

5. Artwork and Creative Practice

The Artist is responsible for the creation, content, materials, and production process of works made during the residency. The Artist must ensure that their creative methods and use of materials comply with applicable laws and safety requirements. Unless otherwise agreed in writing, the Artist retains ownership and intellectual property rights in their artworks.

6. Shipping

6.1 All costs relating to the transportation, packaging, delivery, insurance, and shipment of artworks and materials are the responsibility of the Artist.

6.2 Shipping arrangements should be coordinated with the ACENTRICSPACE residency coordinator at least one week before the planned shipping date.

6.3 The Artist is responsible for ensuring that artworks are properly packed and prepared for transportation.

6.4 If artworks, materials, or personal belongings are left at ACENTRICSPACE after the residency without prior arrangement, ACENTRICSPACE may charge reasonable storage, handling, or disposal costs.

7. Installation and Removal

7.1 Installation and removal expenses, including labor, construction materials, transportation, and other related costs, are the responsibility of the Artist unless otherwise agreed.

7.2 The Artist must consult ACENTRICSPACE in advance regarding installation and removal plans and may not make permanent alterations to the premises or facilities without permission.

8. Information and Image Use

The Artist agrees to provide materials required for residency applications, artist presentations, exhibitions, and project promotion, including a CV/resume, portrait photograph, Artist Statement, project proposal or statement, and images of previous works.

The requested materials should be submitted to ACENTRICSPACE within one week after the beginning of the residency, unless otherwise agreed.

The Artist retains copyright in the materials and artworks they provide. The Artist grants ACENTRICSPACE a non-exclusive, worldwide, royalty-free license to use these materials and documentation of the Artist's residency and artworks for ACENTRICSPACE's own website, social media, press and media promotion, publications, exhibition materials, educational programs, archives, and institutional promotion. This license does not constitute a transfer of copyright or ownership of the Artist's artworks.

9. Sale of Works

9.1 Sales of artworks during the residency are conducted directly between the Artist and the collector. All proceeds from sales belong to the Artist, and ACENTRICSPACE does not charge a sales commission.

9.2 Sales of artworks during a residency-related exhibition are conducted directly between the Artist and the collector. ACENTRICSPACE does not charge a sales commission.

9.3 Any applicable taxes, shipping, packaging, payment processing fees, and other expenses related to a sale are the responsibility of the Artist or buyer, as applicable.

10. Reproductions and Documentation

The Artist agrees that ACENTRICSPACE may photograph, film, and otherwise document artworks created or exhibited during the residency, and may use such documentation, provided that the work is not materially altered, for publicity, press and media coverage, educational programs, archives, publications, exhibition materials, and institutional promotion. This permission is non-exclusive, worldwide, and royalty-free and does not constitute a transfer of copyright in the Artist's work.

11. Booking & Cancellation Policy

11.1 Residency Fees:

  • 1 Month Residency: RMB 7700 — Reservation Fee: RMB 4000; Remaining Balance: RMB 3700.
  • 2 Months Residency: RMB 15000 — Reservation Fee: RMB 7500; Remaining Balance: RMB 7500.
  • 3 Months Residency: RMB 22000 — Reservation Fee: RMB 11000; Remaining Balance: RMB 11000.

The reservation fee forms part of the total residency fee. The remaining balance is payable before or upon arrival.

11.2 Booking & Reservation: A residency place is officially confirmed only after the applicable reservation fee has been paid. The reservation fee is non-refundable. Once received, ACENTRICSPACE will exclusively hold the agreed residency dates for the Artist and will no longer offer those dates to other applicants.

11.3 Cancellation by the Artist:

  • 60 days or more before the scheduled arrival date: the reservation fee is non-refundable, but the Artist may request to transfer the reservation to another available residency period. Each reservation may be transferred only once. The new residency must take place within 12 months of the original residency dates and is subject to availability and confirmation by ACENTRICSPACE.
  • Less than 60 days before the scheduled arrival date: the reservation fee is non-refundable and cannot be transferred.
  • No-show: if the Artist does not arrive as scheduled, the residency will be considered cancelled, and the reservation fee will remain non-refundable.

11.4 Rescheduling: Any request to change the residency dates should be made at least 60 days before the scheduled arrival date. Any change is subject to availability and confirmation by ACENTRICSPACE. Each confirmed reservation may be transferred/rescheduled only once. Once a reservation has been transferred or rescheduled, it cannot be transferred or rescheduled again.

12. Early Termination & Extension

12.1 If the Artist chooses to terminate the residency before the agreed end date, payments already made will not be refunded, and unused residency days will not be credited, refunded, or transferred.

12.2 Any extension of the residency must be requested in advance and is subject to availability and confirmation by ACENTRICSPACE. The fee for the extended period will be charged separately.

13. Visitors & Overnight Guests

The Artist may invite visitors to ACENTRICSPACE within reasonable limits, provided that visitors do not unreasonably affect other Artists, staff, neighbors, or the operation of the premises. Overnight guests require prior approval from ACENTRICSPACE. The Artist is responsible for the conduct of their visitors and guests while on the premises.

14. Personal Belongings

The Artist is responsible for safeguarding personal belongings, valuables, passports, cash, computers, artworks, materials, and equipment. Except where loss or damage is caused by the negligence or misconduct of ACENTRICSPACE, ACENTRICSPACE is not responsible for loss, theft, or damage to the Artist's personal property.

15. Termination by ACENTRICSPACE

If the Artist seriously violates this Agreement, safety requirements, or applicable laws, or causes serious disruption to other persons, the premises, or the normal operation of ACENTRICSPACE, ACENTRICSPACE may terminate the residency immediately. In such circumstances, payments already made will generally not be refunded, and the Artist may be responsible for reasonable repair, cleaning, or other costs resulting from their conduct.

16. Cancellation by ACENTRICSPACE

If ACENTRICSPACE needs to cancel a confirmed residency for reasons within its control, all residency fees paid by the Artist will be refunded. Where possible, the parties may alternatively agree on another available residency period.

17. Force Majeure

If the residency cannot proceed normally due to natural disasters, war, government policies or restrictions, major public health events, significant transportation disruption, changes in visa or entry policies, or other circumstances beyond the reasonable control of either party, the parties will make reasonable efforts to agree on a new residency date or other appropriate arrangement.

18. Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of the People's Republic of China. Any dispute arising from or in connection with this Agreement shall first be resolved through friendly consultation between the Artist and ACENTRICSPACE. If the dispute cannot be resolved through consultation, it shall be submitted to a competent people's court in Shanghai, China.

19. Confirmation of Agreement

By submitting a residency application and checking the box stating that they have read and agree to the ACENTRICSPACE Artist Residency Agreement, the Artist confirms that they have read, understood, and accepted this Agreement. Payment of the reservation fee further confirms the Artist's commitment to the agreed residency dates.

Where this Agreement is provided in both Chinese and English, the parties should identify the language version that prevails in the final version used for acceptance. To avoid ambiguity, ACENTRICSPACE should designate one language version as controlling.
